Recent Safety Case – Care provider fined after employee sexually assaulted by service user

The HSE found that the Action Group failed to properly assess the risks posed to female employees from a particular service user, after a young female employee was abducted, assaulted, sexually assaulted and raped by a service user during a visit to the service user’s domestic property.

The HSE found a history dating back to March 1994 indicating that female employees had been raising concerns about their safety with this particular service user and Action Group did not make suitable amends to their risk assessment, in particular to the health, safety and welfare of female employees dealing with the service user.

Had the Action Group carried out a suitable risk assessment, particularly those posed towards female employees, and put in place the appropriate measures and safe working practices, the incident could have been avoided and the risk to all employees reduced.
